The Victim or Injured person:

The person including driver, third party such as pillion rider, passenger, pedestrian, cyclist who has sustained injuries or suffered damages in a motor accident can file a MACP seeking compensation for their losses themselves.  If the injured person is minor then his legal guardian can file MACP on behalf of minor. And if the injured person is permanently disabled or incapacitated, then his family members or dependents  can file MACP.

Legal Heirs or Representatives:

 In case of the death of a person in a motor accident, their legal heirs or representatives can file a MACP on behalf of the deceased for claiming compensation.

B. Against whom MACP can be filed

A Motor Accident Claim Petition (MACP) can be filed against the following parties, depending on the circumstances of the accident who are referred as defendants:

Driver of the Motor Vehicle:

 If the accident occurred due to the negligence or fault of the driver, a MACP can be filed against the driver seeking compensation for injuries, damages, or losses.

Owner of the Motor Vehicle:

The owner of the motor vehicle can be held liable for the accident and a MACP can be filed against them if the accident occurred due to the negligence of the driver or the vehicle’s faulty condition, improper maintenance, or any other factor for which the owner is responsible. C. Jurisdiction for MACP

As per S.166(2) Motor Vehicles Act,1988 and as held in the Landmark judgement of Supreme Court in Mantoo Sarkar v. Oriental Insurance Co. Ltd. & Ors., (2009) 2 SCC. 244, Motor accident claim petitions shall be made:

The Location of the Accident:

In most cases, the MACP should be filed in the jurisdiction where the accident occurred. This is because the Motor Accident Claims  Tribunal(MACT) in that area would have the authority to handle cases related to accidents within their jurisdiction.

OR

Claimants Location:

In  certain cases the claim can be filed in the Motor Accident Claims  Tribunal (MACT) within whose  local limits  the claimant resides or carries on business

OR

Defendants Location:

In  certain cases the claim can be filed in the Motor Accident Claims  Tribunal(MACT) within whose  local limits the local limits the defendant resides or carries on business.

Motor Accident Claims  Tribunal(MACT) are constituted as per S. 165 of MV Act, 1988 by State Government by issuing notification in the official Gazette. Usually a Judge in the cadre of District Judge is designated as Motor Accident Claims  Tribunal(MACT) and is seated in District Court."

D. Prerequisites for Filing a MACP

To file a MACP, certain prerequisites must be met. The following are common prerequisites:

Accident:

For filing MACP the injured/deceased must have been involved in a motor vehicle accident as a driver, passenger, pedestrian, cyclist, pillion rider, etc.

Notification of the Accident:

 It is important to notify the relevant authorities, such as the police or traffic department, about the accident as soon as possible. Prompt reporting of the accident helps establish an official record of the incident, which can be useful when filing the MACP.

Negligence or Fault:

The accident should have been caused by either own negligence or fault, another party’s negligence or fault, or without any fault of parties involved in the accident.

Documentation:

Gathering necessary documents is crucial to support the MACP and establish the extent of damages and losses suffered. These documents may include:

  • This includes a copy of the FIR (First Information Report), Chargesheet, or Police report .
  • Copy of driving license.
  • Insurance policy.
  • RC book of the vehicle involved in the accident.
  • Medical records.
  • Bills of expenses.
  • Photographs or video evidence of the accident scene and damage caused to the vehicle/property.
  • Any other supporting documents related to property damage or other losses incurred.
  • Witness statements, if any.

This report can serve as crucial evidence when filing the MACP. As per amended Motor vehicles act ,1988 u/s.166(4) , if claimant fails to file a petition within the time limit of six months, the tribunal may consider and convert the police report U/s.159 of Motor Vehicles Act,1988 into a claim petition.

Medical Professionals:

Seek medical attention immediately after the accident to ensure timely treatment and to document any injuries suffered during the accident. This documentation will serve as crucial evidence for claiming compensation under MACP. In case of death, the Post-mortem report and death certificate are essential.

Insurance Company:

If the vehicle involved in the accident is insured then , it is important to notify/report the accident to the  concerned insurance company promptly and documenting all communication with them. This will allow the settlement process to be initiated by the insurance company U/s.149 of Motor Vehicles Act,1988.
